These terms are the agreement between you and Unpound ("we", "us") about your use of the Unpound app. We make them available before you create an account. By creating an account, you accept them.

Unpound is not medical advice
This is the most important paragraph here. Unpound counts what you tell it and estimates an energy target from figures you supply. It is a record-keeping tool, not a clinician. It does not diagnose, treat or prevent anything.
Do not use it to make medical decisions. Speak to a doctor or a dietitian before changing your diet if you are pregnant, breastfeeding, under 18, managing a condition such as diabetes or an eating disorder, or taking medication that interacts with food or with body weight. If you are worried about your relationship with food or with your weight, please talk to someone about it rather than to an app.
Your account
You need an account, created through Apple or Google. Keep access to that sign-in secure; anyone who has it has your diary. You must be at least 16. One person, one account, and the account is yours alone.
The free version and the subscription
Unpound offers a free version and an optional paid version with additional features. You can use the free version without a paid subscription. The app clearly shows which features are included in each version.
Where the store offers it, the first fourteen days are free for a new subscriber. Whether it applies is the store's decision and not ours: Apple and Google each give it once per store account rather than per Unpound account, so if you have subscribed before you may not be eligible. The free period is part of the subscription, not something separate from it. You subscribe, the store charges nothing for the first fourteen days, and after that the subscription continues at the full price and renews automatically until you cancel it. To avoid being charged, cancel before the free period ends; the deadline is in the list below. Cancelling during the free period costs nothing and leaves you access until it runs out. Before you subscribe, the app and the store show the price, the free period, the billing period and the automatic renewal.
- The seller identified at checkout — for App Store or Google Play billing, an entity of Apple or Google respectively — sells and collects payment for the subscription on its own account; we do not. The price shown in the app is the price that store will charge, in your own currency and including any applicable tax.
- A subscription renews automatically at the end of each period until you cancel it with the store. With Apple, cancel at least 24 hours before the free period ends to prevent it becoming a paid subscription. With Google, you may cancel until the end of the current billing period. The renewal date and any cancellation deadline shown by the store at purchase or in your subscription settings control.
- Cancel with the store that sold it. On iPhone: Settings, your name, then Subscriptions. On Android: the Play Store app, your profile, then Payments and subscriptions, then Subscriptions. Cancelling stops the next renewal; access continues until the period you have paid for runs out.
- Deleting the app does not cancel a subscription, and neither does deleting your Unpound account. Only the store can do that, and only from the screens above.
Refunds
Payments and ordinary refund requests are handled by the store where you bought the subscription. Apple: reportaproblem.apple.com. Google: your Play Store order history. This does not limit any rights you have against us or the store under EU and Dutch consumer law.
Price changes
If the price changes, the store will tell you before the change takes effect and the increase will not apply until you agree to it or your subscription renews after the notice period, whichever your local law requires. You can always cancel instead.
Cooling-off period
When you enter into a paid subscription at a distance as a consumer, you generally have a fourteen-day cooling-off period. Information about how to exercise it and about any immediate performance is shown in the app and by the relevant store before purchase. A trial or a request to start the service immediately does not automatically remove your statutory rights.
What you may and may not do
Use Unpound for your own personal, non-commercial purposes. You may not:
- resell, sublicense or redistribute the app or its data;
- extract the food catalogue in bulk, whether by scraping the app's interface or its underlying APIs;
- attempt to access another user's account or any part of the service you have not been given;
- interfere with the service or the servers it runs on.
What you write, and what you keep
The foods, weights and diary entries you enter are yours. We claim no ownership of them. To the extent that intellectual property rights subsist in the name, brand or nutrition values of a food you create, you grant us a non-exclusive, royalty-free licence to store, process and display that information within Unpound to provide the service. That licence lasts while your account exists. If another user has already saved the item in their own library, the licence continues after your account is deleted only as far as necessary to keep the detached item in that existing library. The item cannot be found by new users and remains unlinked from you. Do not put personal data in the name or brand fields. We otherwise process your entries only to run the service, as set out in the privacy policy.
Food data
We cannot guarantee that the figures in the packaged-product catalogue are correct. The packet in your hand is the authority. Where a figure is wrong you can correct it, and your correction is yours.
Availability
We aim to keep Unpound running and will not promise it always will be. The service may be interrupted for maintenance, by a supplier's failure, or by circumstances outside our control. We may adjust features as the product develops, subject to your statutory rights and the section on changes below.
If the service does not work properly
You are entitled to a digital service that conforms to the contract and to necessary updates, including security updates. If the service does not work as you may reasonably expect, tell us. We will try to remedy the problem within a reasonable time and at no cost. If we cannot, or if the problem is serious, you may be entitled under applicable law to a price reduction, termination of the contract and a refund.
Liability
Nothing here limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited — including your statutory consumer rights, which override anything in this section that conflicts with them.
To the extent the law permits, we are not liable for loss that was not reasonably foreseeable when the contract was made. Our liability is otherwise determined by applicable law; this section excludes no mandatory right or remedy you have as a consumer.
Ending it
You can stop at any time: delete your account in Settings, or from the page for it if you no longer have the app. In either case, we delete your account and data as described in the privacy policy. Cancel the subscription with the store separately — deleting the account does not stop a renewal.
We may suspend access or close your account for a material or repeated breach of these terms. We will tell you why beforehand and, where the breach can be remedied, give you a reasonable opportunity to put it right. We will not give advance notice where immediate action is reasonably necessary for security, to prevent fraud or abuse, or to comply with law. Where reasonably possible, you will have an opportunity to request your data before permanent closure. Closure does not limit any statutory right to a refund or damages.
Changes to these terms
We may change these terms only for a valid reason, such as a change in law, a security requirement or a change to the service. A change will not impose additional cost. We will send you the new terms in a form you can keep before they take effect and explain what is changing and when. If a change has more than a minor negative effect on your access to or use of Unpound, you may end the contract without charge within thirty days after receiving the notice or after the change takes effect, whichever is later. That right does not apply if you can keep using Unpound without the change and at no additional cost, and the service remains in conformity with the contract. A change never limits rights you have already acquired.
Governing law
Dutch law applies. If you are a consumer, this does not deprive you of the protection of mandatory law in the country where you live. A dispute may be brought before any court that has jurisdiction under the mandatory rules for consumer disputes, including, where the law so provides, the courts where you live. Only for users acting outside their capacity as a consumer do the courts of Amsterdam have exclusive jurisdiction.
